Terms and Conditions

Welcome to ShareMyLuggage, a peer-to-peer marketplace that connects passengers with extra luggage with those who have unused luggage space. By using ShareMyLuggage, you agree to the following terms and conditions:

1. Acceptance of Terms

By accessing or using ShareMyLuggage, you agree to be bound by these terms and conditions (the "Agreement"). If you do not agree to these terms and conditions, you may refrain from using ShareMyLuggage.

2. Definitions and Use of ShareMyLuggage

For the purposes of this Agreement, the following terms shall have the following meanings:

• "ShareMyLuggage" means the ShareMyLuggage platform and all related services, including the website, mobile app, chat features and any other features that shall be brought into force on a future date.
• "User" means any individual or entity that uses ShareMyLuggage.
• "Luggage Owner or a person who wish to send luggage" means a User who has luggage to be transported by wilfully providing details of his/her luggage including luggage type.
• "Luggage Carrier or a person who wish to carry luggage" means a User who transports the luggage of a Luggage Owner by wilfully providing his/her travel details.

ShareMyLuggage is a platform that only allows luggage owners and luggage carriers to connect with each other. ShareMyLuggage does not provide any transportation services ourselves. ShareMyLuggage does not provide any payment services. ShareMyLuggage does not guarantee shipment of your luggage/items.

3. User Eligibility

To use ShareMyLuggage, you must be at least 18 years old to have a valid account. You must also agree to these terms of service. By using ShareMyLuggage you agree that you are above 18 years.

4.Responsibilities

As a user of ShareMyLuggage, you are responsible for the following:

• Providing accurate and complete information about yourself and your luggage.
• Complying with all applicable laws and regulations.
• Provide accurate and complete information about yourself and your travel.
• Communicate with other users and take a decision to go ahead or not.
• Agree to the fact that you’ll be talking or conversing with a stranger and show due diligence in sharing your personal information.
• Taking all necessary precautions to protect your luggage and your personal safety.
• You go through and adhere to the Best Practices that are listed in the app.

5. Luggage Restrictions

ShareMyLuggage strictly prohibits, and doesn’t take any responsibility, the transportation of the following items:

• Hazardous materials, radioactive materials, etc.
• Illegal items, drugs, narcotics, etc.
• Live animals and any other items prohibited under this category.
• Perishable goods, bleaching powder, peroxides, etc.
• All flammable, non-flammable and poisonous items in solid, liquid and gaseous forms.
• Corrosives items such as acids, alkalis, mercury, etc.
• Explosives, munitions, firearms, guns, fireworks and flares, ammunition including blank cartridges, handguns, fire works, pistol caps
• Flammable liquids and solids - lighter refills, lighter fuel, matches, paints, thinners, fire-lighters, lighters, briefcases and attache case with installed alarm devices, etc.
• Poisons, infectious substances, insecticides, weed-killers, live virus materials, etc.

The list mentioned above is only indicative and not exhaustive. The list will include all such items categorised as harmful / prohibited items by the airlines, railways and all applicable laws.

6. Insurance

ShareMyLuggage does not offer insurance for luggage that is lost or damaged. We recommend that you purchase your own insurance to protect your luggage.

7. Dispute Resolution

Any disputes between luggage owners and luggage carriers should be resolved directly between the parties involved. ShareMyLuggage will not mediate or resolve any disputes.

8. Limitation of Liability

• ShareMyLuggage is not liable for any loss or damage to luggage, or for any personal injury or death that occurs as a result of using ShareMyLuggage.
• ShareMyLuggage is not responsible for any damage to luggage that occurs while it is being transported by a luggage carrier.
• ShareMyLuggage doesn’t take any responsibility of whether luggage owners or luggage carriers are insured or not.
• ShareMyLuggage doesn’t provide any options for payments. Payment terms are decided solely upon the discussion held between the sender and carrier.
• ShareMyLuggage doesn’t take any responsibility regarding the payment terms, payment modes, payment failures, payment frauds or any other such instances related to payments.

9. Termination

ShareMyLuggage may terminate your account at any time for any reason, with or without intimation.

10. Governing Law

These terms of service are governed by and construed in accordance with the laws of Republic of India (Bharat).

11. Entire Agreement

These terms of service constitute the entire agreement between you and ShareMyLuggage and supersede all prior agreements, representations, and understandings between the parties.

12. Severability

If any provision of these terms of service is held to be invalid or unenforceable, such provision shall be struck from these terms of service and the remaining provisions shall remain in full force and effect. This means that if a court or other tribunal finds that one part of the terms and conditions is invalid or unenforceable, the rest of the terms and conditions will still be valid and enforceable.

13. Waiver

If ShareMyLuggage or one of its users wants to waive one of the terms and conditions, they must do so in writing and both parties must sign the waiver.

14. Headings

The headings in these terms of service are for convenience only and shall not affect their interpretation.

15. User Conduct 

Users agree to use ShareMyLuggage in a responsible and lawful manner. Users shall not:

• Use ShareMyLuggage to transport any hazardous materials, illegal drugs, firearms, live animals, perishable goods, or valuable items.
• Misrepresent or omit any material information in their profile or when communicating with other Users.
• Engage in any fraudulent or deceptive activity.
• Harass or abuse other Users.
• Violate the intellectual property rights of other Users.

16. Indemnity

You agree to indemnify and hold ShareMyLuggage, its officers, directors, employees, and agents harmless from any and all claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with your use of ShareMyLuggage or your violation of these terms and conditions.
